A $5.9 million jury verdict won by Powell Law Attorneys James F. Mundy and Bruce S. Zero was the 13th largest jury verdict in a personal injury case in Pennsylvania in 2014, according to a web site that tracks personal injury verdicts statewide.
The web site, topverdict.com, listed the August 2014 verdict in Cancelleri vs. Ford Motor Co. among the top 20 verdicts statewide last year. The case, which was tried in August 2014 before a jury in Lackawanna County Court, involved a Covington Township man who was partially paralyzed when the airbag in his 2005 Mercury Sable failed to deploy in a 2010 front-end collision with another car on Route 307 in Spring Brook Township.
John A. Cancelleri, who was 83 at the time of the accident, and his wife Rosetta sued Ford Motor Co., alleging design defects in the Sable’s airbag and safety restraint system were responsible for Mr. Cancelleri’s injuries. The jury agreed, and awarded $4.4 million in damages to Mr. Cancelleri and $1.5 million to his wife.
Lackawanna County Judge James Gibbons, ruling on a post-verdict appeal by Ford Motor Co., upheld the jury’s verdict in January and awarded an additional $351,000 in delay damages, which increased the total judgment awarded to the Cancelleris to nearly $6.3 million.
